Terms & Conditions (v2 — udkast 2026-06-09)

These terms govern the use of the AI Boat Buddy website and services. By purchasing, subscribing to, or using any AI Boat Buddy service, you agree to these terms.

1. Services Covered

AI Boat Buddy provides two distinct services:

• Boat Reports — one-time AI-generated boat valuation and condition reports, purchased per report.
• API Subscription Service — recurring access to our boat valuation API (Solo, Pro, Pro+ tiers) for brokers and businesses.

Each service has its own commercial terms below. General provisions (intellectual property, liability) apply to both.

2. Boat Reports

2.1 Service Description

AI-generated boat valuation and condition insights based on uploaded information, public data, and market listings.

2.2 Payment & Refunds

Reports are one-time purchases. If you are not satisfied, you are protected by our 100% Money-Back Guarantee — simply contact us within 14 days for a full refund.

3. API Subscription Service

3.1 Service Description

Programmatic access to AI Boat Buddy’s boat valuation, listings, market trends, and insurance-report data via REST API. Sold as monthly or annual subscriptions in three tiers (Solo, Pro, Pro+) with monthly call quotas as published on aiboatbuddy.com/pricing-api.

3.2 Free Trial

Each new subscription begins with a 14-day free trial. You will be asked to provide a valid payment method at sign-up; no charge is made during the trial. You may cancel at any time during the trial to avoid being billed.

3.3 Billing & Auto-Renewal

After the trial, your subscription auto-renews at the published price for your tier (monthly or annual) until cancelled. Prices are shown excluding VAT. EU B2B customers with a valid VAT-ID are billed under the reverse-charge mechanism (0% VAT); other customers are billed at the applicable local rate as calculated by our payment processor.

Billing is handled by Stripe Payments Europe Ltd. (Ireland) on our behalf. Invoices are issued in EUR.

3.4 Cancellation

You may cancel your subscription at any time via the broker dashboard at api.aiboatbuddy.com/dashboard. Cancellation takes effect at the end of the current billing period — you retain API access until that date. No partial refunds are issued for the unused portion of a period.

3.5 Upgrades and Downgrades

You may change tier at any time from the dashboard. Upgrades are prorated and charged immediately; downgrades take effect at the next billing period.

3.6 Refund Policy (API)

Due to the metered, consumable nature of API access, subscription fees are non-refundable once a billing period has begun, except in cases of:
– Documented service outage exceeding 24 hours
– Stripe-level payment errors
– Manifest billing mistakes on our part

3.7 Acceptable Use

You agree to:
– Use the API only within your monthly call quota and the published rate limits.
– Not resell, sublicense, or redistribute raw API responses to third parties without written permission.
– Not use the API to train competing models or build derivative datasets for resale.
– Keep your API key confidential. You are responsible for all activity under your key.

We reserve the right to suspend or terminate access (with prorated refund of unused months for annual subscriptions) if you breach this section.

3.8 Service Levels

Solo and Pro tiers are provided on a best-effort basis with no formal uptime guarantee. Pro+ and Enterprise tiers carry tier-specific SLAs as published.

3.9 Price Changes

We may change subscription prices with 30 days’ advance notice by email. You may cancel before the change takes effect.

4. Intellectual Property

All AI-generated content, API responses, valuation methodologies, and platform materials remain the property of AI Boat Buddy. Boat reports and API responses are licensed to you for internal business use only; they may not be copied, resold, or redistributed without written permission.

You retain ownership of any data you upload or input to the service.

5. No Professional Liability

All information is provided for informational purposes only and should not replace professional marine surveys, financial advice, or legal counsel. AI Boat Buddy cannot be held liable for any decision, loss, or damage resulting from use of our reports or API.

6. Limitation of Liability

While we strive for accuracy, AI Boat Buddy provides no warranties regarding the completeness, precision, or reliability of any valuation, listing, or recommendation. Use of the service is at your own discretion and risk.

Our total liability for any claim arising from the service is limited to the amount you paid us in the 12 months preceding the claim.

7. Termination

We may terminate or suspend your account for breach of these terms, fraud, abuse, or failure to pay. You may close your account at any time by cancelling via the dashboard.

8. Governing Law

These terms are governed by Danish law. Disputes shall be settled by the courts of Denmark.
